I. DEFINITIONS

II. PRELIMINARY PROVISIONS

1. These Regulations set out the rules for the use of the online store palmgarden.com.pl, placing orders for products available at the online store palmgarden.com.pl, delivery of ordered products to the customer, payment by the customer of the sales price of the products, the customer's right to withdraw from the contract and the rules for filing and processing of complaints.

IV. PRICES

1. All prices quoted in the online store palmgarden.com.pl are expressed in Polish zloty (PLN) and include VAT.
2. Prices do not include delivery costs. Delivery costs depend on the method of delivery of the product to the customer, on the value and size of the order and are given when the customer chooses the method of delivery of the product. The total cost of the order (i.e. the price of the products including delivery costs) is indicated in the shopping cart before the customer places the order.
3. The online store palmgarden.com.pl reserves the right to change prices of goods on offer at the online store palmgarden.com.pl to introduce new goods to the offer, carry out and cancel promotional actions on the pages of the online store palmgarden.com.pl or make changes to them.
4. The entitlement referred to in the preceding sentence does not affect orders placed before the effective date of the price change or promotional action terms.

V. PLACING AN ORDER

1. You place an order for the product of your choice by adding it to the Cart and filling out the form available after entering the Cart. The form contains, among other things, the data of the recipient of the order and the address to which the product is to be delivered, as well as the data for the invoice, if different from the data for the receipt of the order, if the customer is to be issued a VAT invoice. When the customer does not choose the option with a VAT invoice, a fiscal receipt is issued. If the customer chooses delivery by courier, he can additionally enter his telephone number for contacting the courier.
2. Placing an order by the Customer by selecting the option: "order with obligation to pay" means making an offer to conclude a contract of sale (purchase) of the ordered product.
3. Once the order has been placed, a confirmation of receipt of the order placed by the customer will be sent to the customer's e-mail address indicated in the form. If the execution of the order is possible, an electronic message will be sent to the customer's e-mail address with confirmation of acceptance of the order for execution, constituting confirmation of the conclusion of the contract.
4. Confirmation of the conclusion of the agreement will include the instruction attached hereto as Appendix 1.

VI. REGISTRATION

VII. PAYMENTS

VIII. DELIVERY

1. The time of receipt of the shipment consists of:
   • Order processing time (picking the goods, form of payment, issuing a sales document, packing the package)
   • Delivery time, depending on the selected method of delivery.
2. It is possible to personally pick up the goods on site at the company's headquarters by telephone appointment.
3. We send courier shipments through a company that provides shipping services for us .
4. In case of ordering non-standard goods, such as plants with heights over 200 cm, the cost and method of delivery is determined individually for each order , and the delivery time may change, of which the customer will be informed.

IX. WITHDRAWAL

1. A consumer who has concluded a contract at a distance or off-premises may withdraw from the contract without giving any reason by submitting an appropriate statement in writing within fourteen days. The withdrawal form is attached as Appendix 2 to these regulations. The fourteen-day period within which the consumer may withdraw from the contract is calculated from the day the customer takes possession of the goods. To meet this deadline it is sufficient to send the statement before its expiration.
2. Return of goods to the seller should be made immediately, no later than 14 days after withdrawal from the sales contract. The return is made upon written confirmation of receipt of the goods by the seller. Along with the returned goods, the customer should return everything he received.
3. The consumer bears only the direct costs of returning the item.
4. In the event of withdrawal from the contract, the online store palmgarden.com.pl shall return to the consumer all payments made by him/her immediately no later than within 14 days from the date of receipt of the consumer's statement of withdrawal from the contract.
5. The online store palmgarden.com.pl will also reimburse the consumer for the cost of delivery as long as the consumer has chosen the cheapest ordinary way to order the goods.
6. In accordance with applicable law, the right to withdraw from the contract is not available in the following cases:
   • when the subject of the service is a non-refabricated item, produced to the consumer's specifications or serving to meet his individualized needs;
   • if the trader has performed the service in full with the express consent of the consumer, who was informed before the start of the service that after the performance of the trader will lose the right to withdraw from the contract;
   • when the subject of performance are things that, after delivery, due to their nature, become inseparable from other things;
   • when the consumer expressly requested that the trader come to him for urgent repair or maintenance; if the trader provides additional services other than those requested by the consumer, or provides items other than spare parts necessary for repair or maintenance, the consumer has the right to withdraw from the contract with respect to the additional services or items.

X. COMPLAINTS

1. The basis for processing a claim is proof of purchase of goods (VAT invoice, receipt or other proof of purchase).
2. Goods delivered for complaint should be delivered to the headquarters of palmgarden.com.pl in Poland in original packaging and at the expense of the complainant. It is permissible to use substitute packaging, but it should guarantee adequate protection during transportation.
3. The goods should be sent complete, especially with accessories that affect the functionality of the equipment in question or that may be one of the reasons for the existence of a defect in the goods or non-conformity with the contract. The goods must be accompanied by a detailed description of the defects or nonconformities that occur, along with information on what situation the defect or nonconformity occurs. In addition, specify the complaint demands and the legal basis for the exercise of rights.

XII. FINAL PROVISIONS
